Terms of Service
1. What Platekind is (and is not)
Platekind analyzes restaurant dishes against the allergen profile you create and returns informational verdicts (Likely Safe, Verify, Avoid, or Unknown), plus suggested questions for restaurant staff.
2. Your responsibilities
By using Platekind you agree that you will:
- Always verify directly with restaurant staff before ordering, regardless of any verdict shown;
- Always carry prescribed emergency medication (e.g., epinephrine) and follow your allergist's guidance;
- Never rely on Platekind as your only safety check;
- Be 18 or older to create an account or manage profiles. Teens managing their own allergies may use the app with a parent or guardian's consent. Profiles for children in your care are entered and managed by you;
- Provide accurate allergen information and keep it current.
3. Assumption of risk; disclaimers
You understand that food-allergen exposure can cause serious injury or death, and that decisions about what you, your child, or a child in your care eat are yours alone, made with the information available to you at the restaurant. The service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, completeness, reliability, or fitness for a particular purpose. AI-generated analyses are probabilistic estimates and are labeled as such in the app.
4. Limitation of liability
To the maximum extent permitted by law, Platekind and its creator shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any personal injury, arising from use of or reliance on the service. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.
5. Accounts
You're responsible for your account credentials. Without an account, data is tied to an anonymous identifier on your device and may be lost if the device or browser data is cleared. We may suspend accounts that abuse the service (e.g., automated scraping, attempting to access other users' data, or reselling output).
6. Subscriptions
Paid plans (Plus, Family) are billed via the Apple App Store monthly or annually, auto-renew until cancelled, and can be cancelled any time (effective at the end of the billing period) in your App Store subscription settings. Prices may change with 30 days' notice. Safety features are never paywalled: paid tiers add volume and convenience only. Refunds for App Store purchases follow Apple's policies.
7. Intellectual property
The app, its dish knowledge base, verdict logic, and content are owned by Annie H., doing business as Platekind. You may use the service for personal, non-commercial purposes. Feedback you submit may be used to improve the service.
8. Changes; termination
We may update the service and these terms; material changes will be posted with a new effective date, and continued use constitutes acceptance. You may stop using the service at any time; deletion requests are handled per the Privacy Policy.
9. Governing law; disputes
These terms are governed by California law. Before filing any claim, you agree to first contact support@platekind.app with a description of the dispute and give us 30 days to try to resolve it informally. Disputes that are not resolved informally will be resolved in the state or federal courts of Santa Clara County, California.
Class-action waiver. To the maximum extent permitted by law, any dispute will be brought in your individual capacity only, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
10. Severability
If any provision of these terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
11. Translations
Parts of the service (for example, allergen names on the allergy card) may be shown in languages other than English. Translations are provided for convenience only and may be imperfect. The English version of all content and of these terms controls. Always confirm allergens directly with restaurant staff.
